NEC3 ECS Subcontractor Commercial Pack — Early Warning + Compensation Event Toolkit

NEC3 ECS may have been superseded by NEC4 on new starts, but a huge volume of UK construction work is still running under NEC3 — particularly framework projects, longer-running infrastructure schemes, and contracts let before 2017 that haven't been re-papered. If you're a subcontractor working under NEC3 ECS, you need tools that match the contract you've actually signed.

This pack is exactly that. Two comprehensive workbooks covering the two procedures that drive most of your commercial position: Early Warnings under cl.16 and Compensation Events under cl.60-65. Both are NEC3-specific — the EW kit uses the NEC3 Risk Register and Risk Reduction Meeting terminology, the CE toolkit uses the 19 cl.60.1 triggers, the cl.63.6 risk allowance, and the cl.65 implementation procedure.

The cl.61.3 8-week notification deadline is the single biggest commercial risk for subcontractors under NEC3 — miss it and your entitlement is gone. The CE toolkit gives you a CE Register that tracks every notification date so you never lose track. The EW toolkit gives you a Risk Register that demonstrates your cl.16 compliance — useful for the cl.61.5 reduction argument if a CE later arises that you didn't EW.

Built by a UK Quantity Surveyor working on NEC contracts daily — same kit I use for my own clients.

What you don't get

This pack is not legal advice. NEC3 CE assessment is technical and the consequences of procedural missteps — particularly missing the cl.61.3 8-week notification deadline — can be significant. For high-value or contentious matters, take advice from an NEC specialist or construction solicitor.
